JUDGEMENT

(1.) This is an appeal against the judgment and order dated 3.2.1999 passed by District Consumer Forum-II, Lucknow in Complaint Case No.522/1997.

(2.) The case of the complainant is that he deposited a cheque of Rs.10,000/- in his account on 7.8.1997. The complainant went to the Bank on 12.8.1997 and 14.8.1997 but the amount was not credited to his account.

(3.) The opposite party filed written statement alleging therein that 8th of August, 1997 was Friday and 9th of August, 1997 was Saturday. On 11th of August there was a strike in the Clearance Section. Hence the cheque was sent on 12th August, 1997. The amount was received on 14.8.1997 and the complainant withdrew the money on 19th August, 1997.
