Challenge in this Revision Petition, under Section 21(b) of the Consumer Protection Act, 1986 (for short 'The Act'), by Jodhpur Vidyut Vitran Nigam Limited (for short 'Vidyut Vitran Nigam'), the sole Opposite Party in the Complaint under the Act, is to the order dated 02.03.2017, passed by the Rajasthan State Consumer Disputes Redressal Commission, Circuit Bench at Bikaner (for short 'the State Commission') in Appeal No.74 of 2014. By the impugned order, the State Commission has upheld the order dated 23.01.2014, passed by the District Consumer Disputes Redressal Forum, Hanumangarh (for short 'the District Forum') in Complaint No.337 of 2012 and has dismissed the Appeal preferred by the Vidyut Vitran Nigam.

In the first place, while allowing the Complaint filed by the Respondent herein, alleging deficiency in service on the part of the Vidyut Vitran Nigam, in raising illegal demand and recovering the same forcefully in respect of a residential electricity connection, for the period from October 2011 upto December 2012, the District Forum had directed the Petitioner to issue fresh bills for the said period on the basis of actual consumption recorded in the new meter. Admittedly, the bills in dispute were raised by the Petitioner on average basis as the meter was not functioning during the afore-said period. The District Forum had also awarded in favour of the Complainant compensation amounting to Rs.1,100/- towards mental agony and a further sum of Rs.1,100/- towards litigation expenses.
