(1.) Though, as per the office report, both the Respondents remain unserved but Mr. Ajay Mahajan, Advocate has put in appearance on behalf of Respondent No.1, the Complainant. In so far as Respondent No.2 is concerned, he happens to be son of the Managing Director of the Appellant Company.
(2.) At the outset, it is pointed out by learned Counsel appearing for the Complainant that the ad interim order dated 18.05.2017, whereby the Appellant was directed to pay to the Complainant the entire amount due in terms of the final order dated 18.01.2016, passed by the State Commission, within three weeks from that day, has not been complied with and even the travel and allied expenses have also not been paid.
(3.) While candidly admitting that the amount due to the Complainant in terms of the order dated 18.01.2016, operation whereof has, admittedly, not been stayed in the Appeal preferred against the said order, learned Counsel appearing for the Appellants submits that the interim direction could not be complied with because of paucity of funds with the Appellants. He prays that some more time may be granted to the Appellants to comply with the said order.
