JUDGEMENT

(1.) The respondent Kheteshwar Lal filed a consumer complaint against the petitioner in the District Forum, Barmer alleging deficiency in service on the part of the petitioner/opposite party inasmuch as the application form sent by him for R.P.E.T. examination to Board of Technical University, Rajasthan, Jaipur by speed post was not delivered. As a consequence the petitioner was deprived of participating in examination and lost his chance. The complaint was contested on merits. However, it was alleged that the bag containing the subject postal article was lost in transit.

(2.) The District Forum, Badmer on consideration of the pleadings and the evidence allowed the complaint and directed thus: -

(3.) Being aggrieved of the order of the District Forum, the petitioner preferred an appeal. The State Commission, however, concurred with the finding of the District Forum and dismissed the appeal. Instead of paying the petty amount of compensation of Rs.20,000/- plus Rs.5,000/- to the respondent/complainant, the petitioner/opposite party has opted to file the revision petition. The revision petition, however, has been filed after the expiry of period of limitation with a delay of 29 days. Petitioner has thus moved an application for condonation of delay of 80 days (29 days as per the computation done by the Registry). The only explanation given for the delay is that the petitioner before filing the revision petition had to take permission from the department and appoint a counsel from the panel of lawyers which consumed time.
