JUDGEMENT

(1.) The complainant/respondent, an erstwhile employee of Ajmer Co-operative Bank Pvt. Ltd. was dismissed from the services of the said bank. He was having a savings bank account with the Panchsheel, Ajmer Branch of the petitioner bank. After his dismissal from services, a sum of Rs.16,23,328/- being the accumulation in his Provident Fund Account was deposited in the aforesaid savings account of the complainant. A cheque of Rs. 11 lacs was issued by the complainant on 22.02.2014, but the bank declined to honour the said cheque on the ground that the balance in his account was not sufficient to honour the said cheque. Being aggrieved, the complainant approached the concerned District Forum by way of a complaint, alleging deficiency on the part of the petitioner bank in rendering services to him.

(2.) The complaint was resisted by the petitioner bank. It was inter-alia stated in the reply filed by the bank that vide letter dated 14.02.2014, received from the Managing Director of Ajmer Urban Co-operative Bank, an amount of Rs. 6,52,661/- plus interest on that amount was withheld. The aforesaid letter dated 14.02.2014 was followed by a formal order dated 26.02.2014, passed by Deputy Registrar of Co-operative Societies, Ajmer, attaching the aforesaid savings bank account of the complainant. According to the petitioner bank, in view of the aforesaid communication, it having withheld a sum of Rs. 65,268/- plus interest, the balance in the savings bank account was not sufficient to honour the cheque of Rs. 11 lacs issued by the complainant.

(3.) The District Forum vide its order dated 11.02.2015, dismissed the complaint. Being aggrieved from the dismissal of his complaint, the complainant/respondent approached the concerned State Commission by way of an appeal. Vide impugned order dated 02.12.2015, the State Commission set aside the order passed by the District Forum and directed the petitioner bank to pay a sum of Rs. 1 lac as compensation to the complainant, alongwith cost of litigation quantified at Rs. 11,000/-. Being dissatisfied on with the said order, the complainant is before this Commission by way of this Revision Petition.
