JUDGEMENT

(1.) THIS revision petition is directed against the order of the State Commission dated 09 -12 -2013 whereby the appeal filed by the petitioner against the order of the District Forum dated 05 -04 -2012 was dismissed for non -prosecution since no one appeared for the petitioner on a number of hearings.

(2.) NO one is present for the respondent/complainant despite service of the notice. Consequently, we have proceeded to hear the learned counsel for the petitioner/opposite party. For the reasons stated in the revision petition the impugned order is set aside and the appeal filed by the petitioner being Appeal No.1854 of 2012 is restored to its original number, subject to petitioner paying cost in terms of our last order directly to the complainant within two weeks by sending a pay order/demand draft along with a forwarding letter either by hand or by speed post. The parties are directed to appear before the concerned State Commission on 19 -05 -2015. On that date the State Commission shall proceed to issue notice in the appeal to the respondent/complainant and after serving the said notice the appeal shall be decided on merits.
