(1.) -heard learned Counsel for the appellant.
(2.) This is an appeal against the order of the Distt. Forum, Sambalpur directing the appellant to replace a pair of chappels which was found defective and also to pay compensation of Rs.100/- to the Complainant.
(3.) The appellant is the seller of the goods to the respondent. The only plea raised by the appellant is that the chappel which was sold to the appellant is alleged to have manufacturing defect for which responsibility may be fixed against the manufacturer is not against him. This submission is not acceptable for the reason that it is the appellant who displayed the chappel in his shop and offered it to be sold to the customers. He was required to sell goods which are not sub-standard goods. If the chappels are found to be defective which is evident from the fact that the same was not usable even if it was repaired by the appellant, the seller is bound to compensate for the same. The Distt. Forum has rightly directed replacement of the chappel which was found defective and payment of "compensation of Rs.100/- for the trouble undertaken by the customer (Complainant ).
