(1.) This is an appeal by the Union of India against the order dated 15.9.2001 passed by the District Forum, Udham Singh Nagar. The complainant has claimed various reliefs before the learned Forum. The Forum rejected the application on all counts but allowed compensation for the delay in installation of the telephone.
(2.) The complainant has applied for a telephone connection in June, 1995. It was installed in October, 1997. The learned Forum has held since the Telephone Department has taken two years, therefore, there was delay and there was deficiency in service, and awarded compensation of Rs.500/-.
(3.) We have heard the learned Counsel for the appellant. The complainant did not appear inspite of notice by registered post. There is specific evidence that no other applicant was given connection breaking any priority and as the matter related to village area, therefore, there was some delay and when the line and poles were installed, then the connections have been given, it was provided to the consumers on their priority basis. In those circumstances, there was absolutely no deficiency in service. We have already said that on various counts, the complainant has wanted compensation but it was refused. Compensation could not have been granted on the account as well. The appeal deserves to be allowed. ORDER the appeal is hereby allowed. The judgment and order dated 15.9.2001 is hereby quashed. The complaint is hereby dismissed. Cost of the appeal shall be easy.
