(1.) Heard the complainant-appellant in person who represents a voluntary Organisation. The voluntary Organisation has taken up the cause of 24 consumers as annexed to the complaint. There appears to be some genuine grievance of the complainant. The allegation is mainly against the dealers although supervisory negligence is attributed to opposite party Nos.1 and 2. In such circumstances, the consumer can be best assisted if the District Forum calls upon the opposite parties to supply the names of the dealers who would be made opposite parties and notice would be sent to them to have their say in the matter. Complainant should also give the period for which there was no supply of the essential commodities to the 24 consumers so that enquiry can be made no effectively.
(2.) There is no doubt a direction to the supply officials to ensure sufficient supply of essential control commodities. However, the conduct of the dealers requires scrutiny in this case. Accordingly, the matter should be re-opened and examined clearly which would have far reaching consequences.
(3.) In result, the appeal is allowed, the impugned order is set aside and the matter is remitted back to the District Forum with the aforesaid conservations.
