CENTRAL BANK OF INDIA Vs. MAYA BANERJEE

JUDGEMENT

(1.) This is an appeal by the Central Bank of India against the order of the Forum dated 14.12.1998 directing it to pay a sum of Rs.48,168/- together with interest @ 10% p. a. from the date of filing of the case till the date of actual payment. Besides, a sum of Rs.25,000/- has been awarded as compensation.

(2.) The complainants approached the Forum with the following allegations.

(3.) One Shri Nirmal Kr. Banerjee, since deceased was the account-holder of the Bank at its Naihati Branch. He was the husband of complainant-1 and father of complainant-2. On 28.8.1994 the said Nirmal Kr. Banerjee visited the Bank to withdraw some money. But unfortunately, a Lady Member of the Staff of the Bank misbehaved with him. She was joined by a Male Member of the Staff. A heated conversation followed and in consequence thereof Mr. Banerjee collapsed and expired within the premises of the Bank. So, the complainants have claimed compensation from the Bank alleging deficiency in service on the part of the Bank and or its employees.
