(1.) GENERAL Manager, Calcutta Telephones was the opposite party in the complaint filed by the respondent a practising medical doctor, before the District Forum, Alipore, Calcutta. GENERAL Manager, Calcutta Telephones is aggrieved by the order of the West Bengal State Commission which awarded a token compensation of Rs. 10,000/- to the complainant. Its further direction was to pay the amount within one month from the date of communication of the order.
(2.) COMPLAINANT, a professional applied to the Telephone Department on 11.8.1993 for shifting of his telephone from his one residence to another. He deposited the telephone instrument on the same day. It took almost three years for the Telephone Department to shift the telephone which was now installed, on 18.7.1996. State Commission did not find any sufficient ground for the Department to take three long years in shifting the telephone. It had observed that this delay caused great mental pain, suffering, financial loss and extreme hardship to the complainant. It also observed that loss suffered by the complainant during the course of three years could not be measured in terms of money. State Commission considering the whole aspect of the matter awarded a token compensation of Rs. 10,000/- to the complainant. After hearing Mr. Sabharwal, learned counsel for the petitioner, we do not find it is a fit case for us to exercise our jurisdiction under Clause (b) of Section 21 of the Act. Further filing of this revision petition has made the respondent-complainant to travel from Calcutta to this place. We dismiss this revision petition with cost amounting; to Rs. 2,000/-. Revision petition dismissed with costs. ______________
