JUDGEMENT

(1.) Both sides are present through their respective Counsels. Perused the judgment. The learned Counsel appearing for the petitioner submits that the judgment of the Forum is totally unsound on the ground that the Forum directed the opposite party to raise bill @ Rs.20/- per month. It appears that the disputed bills were raised @ Rs.316/- per month considering the load factors. In our view the Forum ought to have referred the matter to C. E. I. for adjudication of the dispute instead of undertaking the job of making calculation on the basis of previous bills and fixing the amount of the bill @ Rs.20/- per month. In view of aforesaid we refer this matter to C. E. I. , West Bengal for adjudication of the dispute between the parties. The C. E. I. , West Bengal shall complete the proceeding within a period of 2 months from the date of making the reference and the petitioner is directed to observe all these formalities connected therewith within a period of 3 weeks from this date.
