JUDGEMENT

(1.) The appellant herein is the complainant. The above appeal is filed against the order dt.08.08.2007 of the District Forum, Cuddalore.

(2.) The District Forum has dismissed the complaint on the ground that it is barred by limitation in terms of Sec.24 (A) of CP Act. The District Forum had rendered finding that the complaint is filed on 27.12.1997 and however it is barred by limitation. A perusal of the original letter dt.26.7.2005 is filed herewith, from which date the limitation has to be calculated. Considering the fact that a cause of action arose on 26.7.2005, the complaint is filed well within the time of two years. Accordingly we set aside the order of the District Forum and the appeal is allowed and the matter is remitted back to the District Forum for the disposal of the case on merit. Time to dispose of the complaint is three months from the date of receipt of the order passed by this Commission. Complainant as well as the opposite parties are directed to appear on 12.09.2008 before the District Forum. The Registrar is directed to return the original document filed by the appellant.
