JUDGEMENT

(1.) The opposite party having suffered an adverse order, in the hands of the District Forum, Coimbatore, in CC.No.156/2010 dt.7.10.2010, challenges the same, in this appeal, as appellant.

(2.) The respondent/ complainant, who is a medical practitioner, being the member of Indian Medical Association, joined in the tour arranged by Amar Tours and Travels private Ltd., for which tickets were purchased, and commenced his journey, by Silk Airways from Coimbatore on 13/14.1.2008, with luggage to reach Hongkong via Singapore. On arrival at Hongkong airport, he came to know, his luggage was found missing, for which a complaint was given, and it was reported, luggage was lost during the transit from Singapore to Hongkong.

(3.) The complainant had joined in the tour, for enjoyment and instead of enjoying the same, confined in a hotel because of the missing baggage, in view of the fact, everything was in the luggage, including cash and medicine and dress, thereby the complainant had spent a sleepless night on 14.1.2008. Atlast on 15.1.2008 at 16.50 hours, the complainant received back, the baggage delivered by the opposite party.
