JUDGEMENT

(1.) The Complainant is the appellant.

(2.) Complainant filed a complaint before the District Forum against the respondent/opposite party praying for direction to pay a sum of Rs.1,82,555/- as compensation for deficiency of service for refusing to entertain the supply of refill gas cylinder and to pay the cost.

(3.) The opposite party before the District Forum filed a version in which denied all the allegations of the complainant by stating that there was no demand was made for supply of refill on the date alleged by the complainant and the opposite party acted upon on the basis of rules and regulations and the circulars issued by the District Collector and Indian Oil Corporation and there was no deficiency of service and the claim of the complainant for the compensation of Rs.1,82,555/- are all irregular and the complainant instead of seeking remedy before the proper forum filing complaint before the District Forum is not acceptable.
