JUDGEMENT

(1.) The first and second opposite parties are the appellants.

(2.) Thiru. Arumugam, husband of the first complainant, father of complainants 2 and 3, took an insurance policy with the third opposite party, through their authorized agent the first and second opposite parties, for which, premium paid, sum assured was Rs.3 lakhs. The period of insurance was for 5 years from 08.08.2002 to 7.8.2007. The assured died, in a road accident on 2.10.2002, for which, a case was filed, charge sheet also filed.

(3.) After the death of Arumugam, the same was informed to the opposite parties, claim lodged with necessary documents, but there was no proper reply. Thus, all the opposite parties have failed to settle the claim, committed deficiency, causing mental agony, for which, the complainant is entitled to a sum of Rs.5 lakhs as compensation, in addition to the sum assured namely Rs.3 lakhs. Hence, the claim.
