JUDGEMENT

(1.) Opposite party is the appellant.

(2.) Complainant filed a complaint against the opposite party claiming direction for payment of Rs.3,00,000/- as compensation, Rs.1,00,000/- for the mental agony and Rs.20,520/- spent for medical expenses and Rs.1,80,000/- for the loss of income due to the loss of employment and Rs.5,000/- as costs.

(3.) The 1st complainant was taken for free eye operation camp conducted by the opposite party on 16.9.2006 through the agents and his left eye was operated on the same day along with other persons in the camp and when the bandages were removed he realized his vision on the left eye completely was lost and the opposite party referred him on 2.10.06 to the Aravind Eye Hospital, Madurai there he got admitted and given treatment till 7.10.06 as inpatient and could not restore the vision even by spending Rs.25,000/- as expenses. After filing the complaint the 1st complainant died on 29.9.07 and therefore complainants 2 to 5 are impleaded as legal heirs of the 1st complainant.
