JUDGEMENT

(1.) The unsuccessful complainant is the appellant.

(2.) The complainant/appellant filed a complaint against the opposite parties before the District Forum claiming for the refund of Rs.75,000/- with interest which are paid for getting employment for his son and for Rs.50,000/- as compensation deficiency of service and for mental agony and Rs.5,000/- as costs.

The details of the complaint in brief are as follows :- When the complainant approached the opposite parties for sending his son Rajkumar to get an employment in foreign countries, the 2nd opposite party collected Rs.55,000/- and Rs.20,000/- on 27.11.2003 and stated that the amount was paid to the Dalison Travel Service Company run by 1st opposite party who is the agent for the company. Even after collecting the money they have not taken any steps for sending his son to the foreign country and thereby when the complainant approached the 1st opposite party along with 2nd opposite party, the 1st opposite party gave a letter on 4.11.02 in which the 2nd opposite party signed as a witness. Then on 20.12.04 the 1st opposite party gave a cheque for Rs.35,000/- to the complainant which was dishonoured for want of funds and thereby both the parties acted in a deceitful manner and with deficiency of service and thereby the complainant has come forward with this complaint.
