JUDGEMENT

(1.) The first opposite party is the appellant.

(2.) The first respondent / complainant approached the District Forum, seeking the reliefs namely;- (a) to return the amount of Rs.3,50,000/- with 12% interest upto date of settlement which was paid by the complainant to the first opposite party; (b) to pay Rs.12 lakhs for the supply of inferior quality of Furnace and for the deficiency of service; (c) to pay Rs.10,000/- for legal expenses, on the following grounds.

The complainant for the purpose of melting copper, approached the first opposite party, who is the manufacturer of Furnace, to supply him a Furnace at a cost of Rs.3,50,800/-, paid advance of Rs.10,000/-, which was agreed, as per the letter dated 16.09.2005. Though the first opposite party had agreed to deliver the equipment within 4 to 5 weeks, he delayed unreasonably and installed the Furnace on 18.04.2006, that too, consuming 15 days, which failed to function after trial run, reported to the first opposite party, who repaired Furnace also.
