JUDGEMENT

(1.) The 1st opposite party is the appellant.

(2.) The complainant/1st respondent filed a complaint before the District Forum against appellant/1st opposite party and 2nd opposite party for deficiency of service directing to disperse the balance instalment of housing loan Rs.33,000/- and for Rs.1,50,000/- with 18% interest towards compensation for losses and mental agony.

(3.) The 1st opposite party denied the allegations of the complainant before the District Forum and in the written version, it was stated, out of the total housing loan for Rs.55,000/- first instalment of Rs.22,000/- was granted in 2000 and as the complainant failed to comply with the conditions of the housing loan by not providing necessary documents and further loan instalments could be paid as and when it was despatched after getting sanction from the 2nd opposite party. The demand draft for Rs.15,335/- was sent after deducting necessary amount as 2nd installment loan it was refused by the complainant and filed complaint before the District Forum.
