JUDGEMENT

(1.) This Rule at the instance of an added defendant, was issued on an application under section 115 of the Code of Civil Procedure to examine the legality of judgment and order dated 28.3.1984 passed by the Additional District Judge, Third Court, Chittagong in Civil Revision No.29 of 1983 allowing the same and reversing order dated 6.3.1982 passed by the Munsif, First Court, Chittagong Sadar in Other Suit No. 116 of 1980.
