JUDGEMENT

(1.) The learned District and Sessions Judge, Special Division-1, Sikkim at Gangtok (I/C) has sent a letter bearing reference No.119/D&SJ(SPL-DIV-I) dated 21.08.2019 along with the copy of the order dated 20.08.2019 passed in Title Appeal No.02/2017 (Sonam Doma Bhutia Versus Chief Secretary and others) in which he has expressed his inability to proceed with the matter as his wife is the Counsel appearing for the Respondents No.4 and 5.

(2.) In my view he has rightly shown his inability to proceed with the matter.

(3.) Considering this fact the Transfer Petition is allowed.
