JUDGEMENT

(1.) The State Respondent Nos. 3 to 5 were to file their Counter-Affidavit.

(2.) The last date for this matter was fixed on 2/12/2025, despite the intervening months the State Respondent Nos. 3 to 5 have failed to file the Counter-Affidavit. It is a reflection of lackadaisical attitude of the State Respondents and the total lack of interest in addressing the matter which was filed way back in the month of September, 2025.

(3.) The prayer for time is however allowed in view of the fact that the Learned Government Advocate Mr. Thinlay Dorjee Bhutia is absent today and Ms. Pema Bhutia, Assistant Government Advocate is making the submission on his behalf, with the caveat that cost of Rs.5,000.00(Rupees five thousand) only, each, by each of the Respondents No. 3 to 5, shall be deposited before the Sikkim State Legal Services Authority within a period of ten days from today for utilization in Child Care Institutions.
