JUDGEMENT

(1.) This writ petition is under Article 226 of the Constitution of India, whereby and whereunder the order dated 12.07.2019 (Annexure-4) passed in JBC Case No. 12 of 2018 has been sought to be quashed.

(2.) It is the case of the petitioner, who happens to be the tenant of respondent no. 3, who has hired the premises in question for opening of petrol outlet and in pursuance to the agreement enriched, certain construction has been made upon over the said land, but subsequent thereto respondent no. 3 has approached before the Rent Controller by invoking its jurisdiction for eviction which has been registered as JBC Case No. 12 of 2018.

The Rent Controller has issued notice upon the petitioner, in pursuance thereof, petitioner has put appearance and filed an application under Order VII Rule 11, sub rule (a)(c) read with Section 151 C.P.C. for rejection of the said application, but the same has been rejected against which the present writ petition has been filed.
