(1.) Both the applications are being heard together as arises out of same P.S. case i.e. Mango P.S. Case No.13 of 2018 and disposed of by this common order.
(2.) The petitioners are accused in connection with Mango P.S. Case No.13 of 2018, corresponding to G.R. No.174/2018 registered under Sections 376(2)(i) , 376(D) of the IPC and Section 4 of POSCO Act.

The present case has been registered on the basis of a written report given by informant, namely, Dukni Bagat alleging therein that she is poor lady and her husband has already deserted her and she has two sons and one daughter. Due to poverty she had given her daughter to one Nanak Chandra Seth for her upbringing and she used to occasionally came there to see her daughter and her daughter was very happy. About five months ago, Sri Nanak Chandra Seth disclosed that in his absence Shiv Kumar Mahto, petitioner, had established physical relation with her daughter and on such information she inquired about the matter from her daughter, who is aged about 17 years, disclosed that Shiv Kumar Mahato and Indrapal Saini have established physical relation with her since last one year and after threatening these persons have raped and taken her to Hotels and forced to her to physical relation with other persons. On the basis of these allegations, the present case has been registered.
