JUDGEMENT

(1.) It is not disputed that petitioner has been working as a muster- roll employee since 1st February 1983 but his claim for regularization was declined by order impugned in the writ petition dated 9 th May 2008 (Annexure-11) on the ground that no such sanctioned post of Khalasi, Pump Operator, Filter Operator and Mistry was created in regular establishment. By the impugned judgment dated 21st April 2017 the challenge to the order dated 9th May 2008 was declined on the following grounds :- "The petitioner is aggrieved of order dated 09.05.2008, whereby his claim for regularisation in service has been declined.

The learned counsel for the petitioner referring to chart appended to letter dated 09.08.2002 submits that persons junior to the petitioner have been regularised in service while claim of the petitioner has been erroneously rejected. It is submitted that other employees namely, Yogendra Ram, Bipin Prasad Yadav who were initially appointed on 01.09.1983 and Arun Kumar Singh who was appointed on 21.11.1982 have been regularised in service whereas, the petitioner who was initially appointed on 01.02.1983 has not been extended a similar benefit.
