JUDGEMENT

(1.) In spite of opportunity given to the respondents way back on 31.01.2019 the counter affidavit has not been filed.

(2.) The petitioner was appointed and posted as a Teacher at Middle School Ghoranji Deori - I, within the district of Giridih. The petitioner was appointed on 10.12.1960 and superannuated on 31.01.2003. The petitioner claims that he was working as a Trained Teacher (Intermediate) and was provided the scale of I.A. Trained Teacher w.e.f. 1975. He was granted the time bound promotion also. His claim is that since he had completed Graduation in the year 1983 he should have been granted the pay scale of graduate trained teacher. He submits that he has filed several representation but no action has been taken.

(3.) Counsel for the petitioner submits that suffice it would be if a direction be given to the respondents, at this stage to dispose of the representation of the petitioner and decide the claim of the petitioner.
