JUDGEMENT

(1.) Heard Mr. Amitabh Prasad, learned counsel for the appellant and Mr. Arbind Kr. Singh, learned counsel for the respondents.

(2.) The present interlocutory application has been filed for withdrawal of the second appeal.

(3.) In paragraph no. 4 it is stated that during the pendency of the second appeal both the parties i.e. appellant and respondent have settled their dispute amicably outside the Court. Accordingly, the appellant does not want to pursue the appeal further.
