JUDGEMENT

(1.) This writ petition is under Article 226 of the Constitution of India whereby and whereunder the petitioners have approached this Court after issuance of notice under Section 13(4) of the SARFAESI Act, 2002.

(2.) Serious objection has been raised by the learned counsel appearing for the respondent-Bank by taking the ground of availability of alternative remedy of Tribunal under Section 17 of the SARFAESI Act, 2002.

(3.) The aforesaid aspect of the matter has been considered by the Hon'ble Apex Court in the judgment rendered in the case of United Bank of India v. Satyawati Tondon and others reported in (2010) 8 SCC 110.
