JUDGEMENT

(1.) I.A. NO.2060 of 2019

(2.) This interlocutory application has been filed under Section 389(1) of the Code of Criminal Procedure, for suspension of the sentence and enlarging the appellant on bail, during the pendency of the present appeal.

(3.) Learned counsel for the appellant has submitted that though the Investigating Officer has stated that the alleged weapon (Khanti) has been recovered on the confessional statement of the appellant but the independent witnesses have not testified about recovery of the weapon on the basis of confessional statement of the appellant. It is argued that, in fact, there is no eye witness to the occurrence and all the witnesses are hearsay.
