JUDGEMENT

(1.) Apprehending their arrest in connection with Adityapur P.S. Case No.236 of 2019 instituted under Sections 406 / 420 / 467 / 468 / 471 / 34 of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail.

(2.) Heard the parties.

Learned senior counsel appearing for the petitioner of A.B.A. No.6101 of 2019 namely Madan Kumar Sinha submits that the petitioner of A.B.A. No.6101 of 2019 namely Madan Kumar Sinha being the power of attorney holder of the co-accused Uma Shankar Lal and the learned counsel for the petitioner appearing for the petitioner of A.B.A. No.5907 of 2019 namely Umashankar Lal submits that the petitioner of A.B.A. No.5907 of 2019 namely Umashankar Lal is the owner of the land and they jointly submit that the allegation against the petitioners is that they have executed a sale-deed in favour of the informant suppressing the fact that the said land has been mortgaged with the UCO Bank against a loan by the co-accused Manoj Kumar Sinha. It is submitted that the allegation against the petitioners is false. It is then submitted that the alleged loan taken by the co-accused Manoj Kumar Sinha has already been liquidated. It is lastly submitted that the petitioners are ready and willing to co-operate with the investigation of the case and to jointly pay Rs.17,11,000/- to the opposite party No.2 without prejudice to their defence in this case. Hence, it is submitted that the petitioners be given the privileges of anticipatory bail.
