JUDGEMENT

(1.) Petitioner is apprehending his arrest in connection with Palamau (T) P.S. Case No. 264 of 2015, corresponding to G.R. No. 918 of 2015, registered under Section 500 of the I.P.C. and Sections 66A, 67, 67A of the Information Technology Act, lodged on the basis of one written report given by Dr. Amar Singh, Registrar, Nilambar-Pitamber University addressed to Officer-in-Charge, Town P.S., Medininagar, Palamau alleging that petitioner is running a software/cyber cafe named "Path e-Solution at Jail Hata, Mohan Cinema Road, P.S.-Town Thana, Medininagar, Dist- Palamau and as per his tender/request, he was assigned by the authorities of the N.P. University on 14.10.2014 to conduct and operate the website of N.P. University considering his quotation for purposes of publication of Examination Programmes, issuing Admit cards of the students and publication of result etc. and other allied works. It is alleged that petitioner used to submit his remuneration bills which was always cleared by the concerned authorities of the University, till the date and there was no dues of any sort outstanding against the University to be paid to the said accused. On 29.04.2015 at about 09:00 P.M., the said Naveen Kr. Agarwal called the Vice-Chacellor of the N.P. University on his mobile and demanded Rs. 5 lacs and when the he was asked to submit his bill, if any, in the University, the accused threatened the Vice Chancellor with dire consequences. It is alleged that he shut down the website of the Univesity and uploaded obscene photographs in the website of the University in order to abuse and defame the Vice Chacellor and University. On the basis of this allegations, the instant case was instituted.

(2.) It is relevant to note that earlier petitioner has moved before this Court in A.B.A. No. 3163 of 2015, which was rejected vide order dated 05.11.2015 and thereafter petitioner moved in W.P. (Cr.) No. 203 of 2017 which is pending before this Court and thereafter petitioner has again moved in A.B.A. No. 674 of 0218, which was dismissed as not maintainable under order dated 22.11.2018 by this Court and thereafter, petitioner has moved before this Court in Cr.M.P. No. 3474 of 2018 which was allowed vide order dated 10.10.2018. Hence, this is third anticipatory bail application.
