(1.) In these writ applications a question of Constitutional importance is involved, which in our considered view, is of paramount importance, over and above the individual rights of the petitioners in the writ applications, if any.

The State Government in its Department of Personnel, Administrative Reforms and Rajbhasha, has come out with a Notification No. 5938 dated 14.7.2016, as contained in Annexure-6 to W.P.(C) No. 1387 of 2017, directing that in 13 Scheduled Districts of the State, as detailed in the said notification, only the local residents of the concerned districts shall be eligible to be appointed on the District Cadre Class-III and Class-IV posts, for a period of 10 years from the date of publication of the notification. The immediate impact of this notification is that the candidates residing outside the concerned district, or the candidates residing outside the State, are deprived from submitting their applications and being considered for appointments to Class-III and Class-IV posts, in the Government offices in the Scheduled Districts.

Advertisements have also been issued for appointments on the vacant Class-III and Class-IV posts in the Government offices in the Scheduled Districts, with the eligibility criteria for the candidates of being local residents of the concerned districts, pursuant to the aforesaid notification, and the petitioners are aggrieved by the issuance of such advertisements for filling up the Class-III and Class-IV posts in the Scheduled Districts.
