(1.) Three persons namely, Gunju Oraon alias Ghunghat Oraon, Baidyanath Sao and Narayan Oraon were named as suspect who have abducted Bodara Sao, husband of the informant. The informant gave her fardbeyan at 12:30 a.m. on 16.10.1997 at her village-Karaundih to the officer-in-charge of P.S. Gumla, on the basis of which Gumla P.S. Case No. 222 of 1997 was registered under section 364/34 IPC. After the investigation, charge-sheet was submitted against the above-named accused persons and the accused-Etwa Oraon under sections 364, 302, 201, 120B/34 IPC.
(2.) The appellants have faced the trial in S.T. Case No. 42 of 1998 on the charge of abducting Bodara Sao with intention to murder and to cause his death in furtherance of their common intention. They have also been charged of causing disappearance of the dead-body of Bodara Sao. During the trial, the prosecution has examined altogether six witnesses; the informant is P.W.6 and the father and sister of Bodara Sao, the deceased, have been examined as P.W.1 and P.W.2 respectively.
(3.) Dr. Krishna Prasad, who has conducted autopsy over the dead-body, has found following injuries on Bodara Sao:
