V/S
STATE OF JHARKHAND Respondents

JUDGEMENT

(1.) THIS contempt application has been filed by the petitioner being aggrieved with non -compliance of the order of this court passed on 19.4.2007 in W.P.(S) No. 1141 of 2007, by the respondents.

(2.) THE petitioner, who had retired from service under the respondent University, has claimed for payment of his retiral dues. When the retiral dues was not paid, the petitioner filed the writ application, in which by the impugned order, the court had directed the respondents to pay the entire retiral dues including the admitted dues to the petitioner, within the time stipulated in the order. Despite such direction, neither the respondent University, nor the respondent State had ensured payments to the petitioner, hence this application for contempt.

(3.) COUNSEL for the petitioner submits that the funds in respect of the arrears on account of revision in the UGC Pay Scale, have been released in favour of two similarly situated employees by the concerned Department of the State Government, pursuant to the orders passed in the contempt petition, but in the case of the petitioner, the same has not been released by the State Government.
