JUDGEMENT

(1.) The petitioner has been suspended by the impugned order and it is revealed from the record that the said suspension order was challenged before this Court in Writ Petition No. 4608 of 2002, which was decided by this Court on 17.7.03. Thereafter, the suspension order was again challenged in WPS No. 945 of 2006, which was decided on 2.5.06 by this Court and both the said writ petitions were dismissed by this Court.

(2.) Learned counsel for the petitioner contended that the accusedpetitioner is facing trial since long and as such, his suspension should be revoked. He also relied upon the judgment of Patna High Court, Annexure-6 to the writ application, in which, the suspension order of the co-accused has been quashed by the Court.

(3.) Learned counsel appearing for the State contended that the accused-petitioner is involved in Fodder Scam Case and the petitioner also challenged the suspension order twice before this Court unsuccessfully.
