JUDGEMENT

(1.) LEARNED counsel for the petitioner submitted that the petitioner is not paid the retirement benefits and, therefore, the present petition has been preferred.

I have heard learned counsel appearing on behalf of the respondents, who has submitted that the petitioner's services was terminated on 13th February, 1988 and as he has been dismissed from service, the petitioner is not entitled for several retirement benefits. Nonetheless, the petitioner has been paid an amount of Rs. 24,056/ - towards the C.P.F. vide Cheque No. 873678 dated 16th December, 2005. Thereafter, a writ petition bearing C.W.J.C. No. 1178 of 1998 (R) was preferred by the petitioner, which was disposed of by this Court vide order dated 25th August, 1999, wherein, also no relief of this type of payment was granted. Thereafter, the present petitioner instituted Letters Patent Appeal bearing L.P.A. No. 442 of 1999(R), which also dismissed by a Division Bench of this Court vide order dated 3rd February, 2000, with a liberty to the petitioner to approach the respondents and, therefore, it is submitted by the respondents that all the legally payable amount have already been paid to the petitioner and nothing more is required to be paid, as stated in the counter affidavit.
