JUDGEMENT

(1.) Heard the parties and with their consent this writ petition is being disposed of at the stage of admission itself.

(2.) The prayer of the petitioner in this writ petition is for quashing the order as contained in Annexure-5 dated 07.08.2001 issued by the Director Social Forestry Department of Forest and Environment, Government of Bihar, directing for recovery of embezzlement amount from the gratuity and leave encashment of the late husband of the petitioner who died on 24.11.1998 and also for quashing the order as contained in Annexure-13 dated 14.10.2004.

(3.) As it appears that the husband of the petitioner was Range Officer of forest and was being departmentally proceeded for certain charges. He was also facing criminal trial for embezzlement of Government fund, but before any order could be passed by the disciplinary authorities on the basis of the report of the enquiry officer, the petitioner committed suicide on 24.11.1998.
