INDIA AUTOMOTIVES LIMITED Vs. B.S.F.C.

JUDGEMENT

(1.) THIS interlocutory application has been filed on behalf of the lessor -Hind Tools and Dyes Private Limited for return of the leasehold land with shade (sic) and original documents.

(2.) IT is submitted by Mr. Amar Kumar Sinha that the lease had expired on 20.11.1993 but thereafter it was not renewed as the lessee did not fulfill the terms of the agreement.

(3.) IN the circumstances, till the winding up proceeding is pending, the prayer of the lessor for return of the land shade (sic) and documents cannot be allowed.
