JUDGEMENT

(1.) HEARD Mr. Mishra, learned counsel appearing for the petitioner and Ms. Nehala Sharmin, learned Jr. Counsel for the State.

IN this writ petition, the petitioners have challenged the legality and validity of the order dated 29.8.1998 contained in Annexure -12 to the writ -petition, terminating the appointment of altogether 611 employees including the petitioners with effect from 29.8.1998. Some of the aggrieved persons moved this Court in W.P.(S) No. 3769 of 2001, C.W.J.C. No. 570 of 2001, C.WJ.C. No. 1647 of 2001, W.P.(S) No. 1625 of 2002 and W.P.(S) No. 2640 of 2002, which were heard together and were analogously disposed of by a common order on 7.3.2003, holding that the principles of natural justice was not complied with before terminating the appointment of the writ petitioners, and accordingly, the impugned order dated 29.8.1998 was quashed and the respondents were directed to issue a fresh show -cause notice to these persons, even by general notice inviting show -cause within a period of three weeks, and the aggrieved persons were directed to file a show -cause within a period of three weeks from the publication of such notice.

(3.) BOTH the parties stated that this case can be disposed of on the same terms. I also find that the case of the present petitioners in this writ petition also stands on the same footing, and therefore, this writ petition is also being disposed of in terms of the order passed. on 7.3.2003 by this Court in W.P.(S) No. 3769 of 2001 with analogous cases, and the respondents are directed to issue fresh notice of show -cause to the petitioners within a period of three weeks from today. The petitioners, thereafter, shall file their show -cause within ten days from the date of receipt of the show -cause notice, and the respondents shall dispose of the matter after considering their show -cause within a period of one month from the date of filing of such show -cause.
