(1.) This writ petition under Article 226 of the Constitution of India has been filed on behalf of the petitioner seeking issuance of a direction upon the respondents to appoint the petitioner as an Aangan Bari Sewika as she fulfils all the conditions and she belongs to the same village. In substance, the case of the petitioner is that she has not been appointed as Angan Bari Sewika in the Aangan Bari Centre at Chegona in spite of her selection in the General Body meeting and in her place, respondent no. 7 who does not belong to the same village and allegedly managed the Government officials, has been appointed as Aangan Bari Sewika.
(2.) Counter affidavit has been filed denying all the allegations. It is contended on behalf of the petitioner that the petitioner filed several representations before the Deputy Commissioner but he has not decided the representations filed by the petitioner. The counter affidavit does not disclose that the representation filed by the petitioner was decided by the competent authority.
(3.) In the facts and circumstances of this case, it would be just and proper to direct the respondent no.2, the Deputy Commissioner to dispose of the petitioner "â„¢s representation expeditiously. The petitioner may file a fresh representation along with a copy of the earlier representation within one month from today before the Deputy Commissioner, Palamau at Daltonganj (respondent no. 2) annexing a copy of this order. The Deputy Commissioner shall dispose of the representation of the petitioner expeditiously, preferably within four months from the date of presentation of the representation. While hearing the representation, the Deputy Commissioner shall give opportunity of hearing to the petitioner, respondent no.7 and any other party involved in the matter. The Deputy Commissioner after hearing the parties, shall dispose of the representation of the petitioner by passing a speaking order .
