JUDGEMENT

(1.) HEARD Sri Sanjay Prasad, learned counsel for the petitioners and J.C. to Sr. S.C. -I for the respondents.

(2.) PETITIONERS in this writ application have prayed for a direction to the respondents to pay to the petitioners salary for the strike period for the year 1999, salary for the month of November, 2000 and also one installment of arrears of salary on the basis of pay revision, which has not been paid.

IN its counter affidavit, the Respondent No. 3 namely the Superintendent, Patliputra Medical College and Hospital, Dhanbad has admitted and acknowledged the claim of the petitioners that the salary for the strike period for the year 1999, salary for the month of November, 2000 and arrears of pay revision has not been paid to the petitioners. It is further sought to be explained that the arrears of salary could not be made on account of paucity of funds since the allotment of funds was not forthcoming from the State of Bihar at the relevant time.
