(1.) HEARD learned counsel appearing for the petitioner and learned counsel appearing for the State.

LEARNED counsel appearing for the petitioner submits that prayer for bail of the petitioner was earlier rejected by this Court, vide its order dated 5.7.2007 passed in ABA No. 1074 of 2007 but the petitioner has renewed his prayer for bail in the changed situation as the police after investigation did find that the petitioner had not involved himself in the commission of offence as has been alleged and moreover, very foundation of the case has not been found to be true by the Investigation Officer as it is said that one N.K. Singh had gone to the office of Accountant General for getting a pay slip of Mr. B.D. Ram, the D.G.P. issued but in course of investigation, it has transpired that Mr. B.D. Ram at that point of time was not holding the post of D.G.P., rather he was the Chairman of Jharkhand Police Housing Co -operative Society a entity incorporated under the Companies Act and hence, he was not required to get his pay slip issued by the Accountant General Office and that the Investigating Officer on verifying the visitors' book and also the other slips relating to visit by a person to the office of Accountant General did find that the petitioner had never visited the office on the relevant day rather some one had visited the office and therefore, charge -sheet had been submitted under Section 506 of the Indian Penal Code as against the unknown as the Investigating Officer has never found the case to be true under
