(1.) PETITIONER has prayed for a direction to the respondents to pay him his pension, arrears of pension, gratuity, leave encashment and leave salary for 33 days.

LEARNED counsel for the petitioner submits that during the pendency of this writ application, the respondents have paid him the amount of leave encashment though deducting from the account the amount of salary for 33 days which was allowed to the petitioner and to several other employees like him by a Government Notification as leave with salary for the period they had gone on strike.
(3.) LEARNED counsel for the respondent State is present. Though no counter affidavit has been filed but from the annexures to the writ application and from the submissions made on behalf of the petitioner by his learned counsel, it does appear that the petitioner was appointed as a Government employee and had superannuated from service as an Assistant Statistical Officer on 30.06.2007. Payment towards leave encashment, Provident Fund and Group Insurance has been released to the petitioner but, as per his claim, the other retiral benefits including fixing and payment of pension has not been done. The petitioners representations do not appear to have been disposed of as yet by the concerned authorities of the respondents.
