JUDGEMENT

(1.) This is a petition for contempt alleging non-compliance of the order dated 31.01.2008 passed in W.P(Cri.) NO.41/2006 by which the learned Single Judge had directed the respondents to ensure that the release of the wooden logs be made to the petitioner as and when he appears to take possession with required protection within four weeks and seek explanation of the Officer-in-charge, Narayanpur P.S. why the said logs were not produced.

(2.) It is informed by the counsel for the respondent-contemnor that the petitioner himself did not appear before the authorities to receive the log of woods.

(3.) Since the petitioner himself has failed to carry out the order passed by the learned Single Judge, the contempt petition alleging non-compliance of the order at the instance of the respondentcontemnor, is not fit to be entertained as the order was conditional in nature and the petitioner has failed to comply his part.
