JUDGEMENT

(1.) Heard the learned counsel for the petitioner and learned counsel for the Respondents.

The petitioner, in this writ application, has prayed for an order directing the Respondents to reconsider the case of the petitioner for his appointment to the post of Police Constable in the district of Sahebganj in the light of the memo. dated-07.05.2005, issued by the Commandant, Jharkhand Armed Police Force-8, Palamau Camp, Bokaro (Respondent No. 4).

It appears that pursuant to an Advertisement, issued by the concerned authorities of the Respondents, inviting applications from eligible candidates for filling up the vacancies by way of appointment on the post of Constables in the State Police Service, the petitioner had submitted his application under the Scheduled Tribe Category. The petitioner was called upon to appear at the prescribed examinations. He appeared at the examinations including the Physical Tests in course of which, his height measurements and chest measurements were recorded. The results of the Tests were published in which the petitioner was declared to be successful. Thereafter, he was forwarded for his medical examination. In course of the Medical examination, his height was again measured but this time, it was recorded as less than 160 cms. On the basis of the revised measurements of the petitioner "â„¢s height and on the ground that the petitioner did not qualify as per the standards prescribed, the petitioner was refused appointment.
