JUDGEMENT

(1.) Heard the learned counsel for the petitioner and the respondents.

This writ petition under Article 226 of the Constitution of India has been filed by the petitioner seeking issuance of a direction to the respondents to pay pension along with arrears and upto date interest to the petitioner who has superannuated from service of the Central Coalfields Limited as far back as on 31.7.2001, but even after lapse of seven years, the amount has not been paid to the petitioner.

(3.) In substance, the petitioner is claiming pensionary benefits with arrears and interest from the date of his superannuation. Respondent no. 5 has filed counter affidavit in which in para 5 it is stated that the pension claim including arrears of petitioner has already been settled at the rate of Rs. 961/- per month on 22.7.2008 and the same has been sent to be credited in the savings bank account of the petitioner at the SBI, Bhandaridih Branch. The arrears of pension has also been settled to the tune of Rs. 79,763/- which has also been sent to be credited in savings bank account of the petitioner.
