JUDGEMENT

(1.) HEARD Sri Dhananjay Kumar Dubey, learned counsel for the petitioner and J.C. to Sr. S.C. -I for the respondent State.

CHALLENGE in this writ application is to the order as contained in Memo No. 4533 dated 13.08.2004 (Annexure -6) issued by the Respondent No. 5 whereby a punishment of stoppage of one annual increment, equivalent to two black marks has been inflicted on the petitioner. A prayer has also been made for quashing the order dated 21.04.2006 (Annexure -8) of the appellate authority (Respondent No. 4) whereby the appeal preferred by the petitioner against the impugned order of the Respondent No. 5, has been dismissed. The petitioner has also prayed for a direction upon the respondents to pay the salary to the petitioner for the period from 01.07.2003 to January, 2004 on the ground that the petitioner had continued to discharge his duties during the aforesaid period at the station where he was posted.

THE facts of the petitioner's case is that he was initially appointed as a Constable in the year 1982 in the district of East Singhbhum and since the date of his joining the post on 11.06.1982, he had been discharging his duties on being posted at the Sakchi Police Station, Jamshedpur. In the month of June, 2003, a general order of transfer was issued by the Police Headquarters by which the petitioner was also transferred from Jamshedpur to Chatra and pursuant to the transfer order, he was relieved from his post on 01.07.2003 to enable him to join the transferred post.
