JUDGEMENT

(1.) By Court The claim of the petitioner is that since pursuant to the CIL "â„¢s order No. CIL/C-5A (iii)/51720/872 dated 29/08/1996, while he was working as Senior Geologist in E-3 grade, was transferred in his existing capacity/grade from CMPDI to C.C.L and was posted in Vigilance Department of CCL (HQ) Ranchi and, therefore, the respondents be directed to absorb him in the Vigilance Department of CCL itself for which he filed a representation but the concerned respondents did not paying any heed to it.

(2.) Considering the claim and grievance of the petitioner, in my view, the claim of the petitioner requires to be considered and determined by the authorities of the Coal India Limited who is competent to decide the issue.

(3.) Accordingly, this writ petition is being disposed of by giving liberty to the petitioner to file a fresh representation stating in detail about his claim and grievances alongwith supporting documents, if any, before respondent no. 3 the Director, Personnel, Coal India Limited, Calcutta within a period of four weeks from today. If such a representation is filed by the petitioner within the aforesaid period, the concerned respondent shall consider and determine the claim of the petitioner by a reasoned order in accordance with law within a period of eight weeks from the date of receipt of such application. It is made clear that I have not gone into the merit of the claim of the petitioner.
