JUDGEMENT

(1.) HEARD the parties.

(2.) THIS is most unfortunate case in which the petitioner, who has retired from State government service on 30.11.2001, has not been paid as yet the benefits of first time -bound promotion, which he was entitled to get on completion of ten years of his service i.e. from 01.07.1984 in respect of the fact that during pendency of this writ petition, the Deputy Commissioner -cum -District Registrar, Pakur, by his letter no.140 dt. 01.9.2004 (Annexure -14) wrote to the Deputy Secretary, Department of Registration, Government of Jharkhand, Ranchi to give the benefit of first time -bound promotion and A.C.P. etc. to the petitioner and all relevant papers were also sent along with the said letter by the Deputy Commissioner, but, unfortunately, the Government of Jharkhand is sleeping over the matter, and the petitioner has not paid the aforesaid benefit. In the counter affidavit filed by the respondent nos. 2 to 5 it has been stated very vaguely that the matter of granting first time - bound promotion to the petitioner is under active consideration. The said counter affidavit was filed in the year 2004, and though, more than five years have already been passed, but still, the grievance of the petitioner has not been redressed as yet.
